Insurance Department will allow companies to extend current policies under new HHS rules

Sandy Praeger, Kansas Commissioner of Insurance, announced today that the Kansas Insurance Department will allow companies selling health insurance in the state to continue to renew policies that don’t meet the requirements of the Affordable Care Act (ACA) that went into effect on January 1, 2014.

Under this transitional policy, companies will be allowed to renew certain “non-grandfathered” plans for policy years beginning on or before October 1, 2016.  Non-grandfathered plans are those issued after March 23, 2010, but prior to January 1, 2014. (Read HHS rules news release PDF)

Kansas Professional Employer Organization Registration

The Kansas Professional Employer Organization Registration Act went into effect January 1, 2014. Professional Employer Organizations operating within Kansas are required to complete their initial registration not later than 60 days after the effective date of the Act, using the Application Form linked below.

Bulletin 2013-1: Compensation for Sales Taxes and Fees in Motor vehicle Total Loss Settlements

The Kansas Insurance Department has recently received complaints from motor vehicle owners that companies are refusing to compensate for sales taxes and fees in settlements for total loss of motor vehicles. In response, the Department surveyed a number of companies and confirmed that the requirement that owners be compensated for sales taxes and fees was not uniformly followed. This Bulletin is issued to remind companies of their obligation to include sales taxes and fees in all settlements for motor vehicle total loss claims and to explain how settlements should be calculated. Bulletin 2012-1: Reissuance of Bulletin 1991-4; LIfe and Accident and Health Insurance Advertising by Third-Party Marketing Entities

Due to a growing problem with advertising practices by third-party marketing entities, the Department issued in January 1991 Bulletin 1991-4 in order to remind insurers authorized to transact life and/or accident and health insurance in Kansas of the applicability of K.A.R. 40-9-100 and K.A.R. 40-9-118 to the marketing activities conducted by third-party entities. This revised disclaimer is necessary due to the recent amendments to the Kansas Life & Health Insurance Guaranty Association Act effective 7-01-2011.
